The Maximum Compensation Rate

The Maximum Compensation Rate (“MCR”) is the highest weekly benefit which an employee may receive for Temporary Total Disability “TTD”).  The MCR is set by the Department of Labor each year.  The year in which the Ee was injured determines which maximum rate is applicable.  The following are the rates for a few years.

                        2018               $883.00

                        2019               $899.00

                        2020               $925.00

                        2021               $911.00

High wage earners are, in effect, hurt by the MCR since it caps the amount of TTD which can be received.  For many other workers, TTD approximates take-home pay since as a general rule WC benefits are not taxable.
